As a police officer and lawyer, I have encountered malicious clients and complainants. One of the types of individuals that is becoming more common are those who secretly record or videotape conversations on their mobile phones. In some cases, especially in domestic violence incidents, a wife waits for her drunk husband to shout loudly or break objects, then uses the screams and noise as evidence for divorce or criminal charges.
It's not just police officers and lawyers who deal with this. Recently, at social gatherings or in casual settings, some people have filed harassment claims based on offhand remarks, sometimes even turning light physical contact into accusations of sexual assault. In daycare centers, kindergartens, and schools, minor physical contact made with the intention of reprimanding a child can be reported as physical or emotional abuse, leading to police investigations, including reviewing CCTV footage in detail.
The Surge in Recordings and Malicious Use of Evidence
One recent incident I encountered involved a parent at a daycare secretly hiding a recorder in their child's bag to capture the teacher yelling at the child, as well as recording the child's crying to accuse the teacher of emotional abuse. Furthermore, with the implementation of laws to prevent workplace bullying, there has been an increase in recordings related to inappropriate behaviors, such as making employees perform tasks beyond their job scope or isolating them from others. These recordings have also been submitted as evidence in legal proceedings.
As a result, various organizations such as law enforcement, the National Human Rights Commission, the National Rights Commission, the Military Human Rights Center, courts, and the Ministry of Employment and Labor are receiving an increasing number of complaints with audio or video evidence, such as recordings, mobile phone messages, and requests for forensic analysis of CCTV or mobile phones.
What About Medical Institutions?
In the case of malicious patients, it is common for them to intentionally withhold information about previous conditions during the medical history interview. This can lead to incorrect diagnoses or unnecessary treatments, which the patient later claims resulted in further harm, leading to criminal charges or civil lawsuits for damages.
For the healthcare provider conducting the interview, it is impossible to know whether the patient is being truthful about their medical history. However, many healthcare professionals fail to record the interview accurately in the medical records. During criminal or civil proceedings, patients may argue that the doctor did not ask the right questions, or that the doctor made the wrong judgment, causing the patient's condition to worsen. In some cases, the patient may even record the interview with their mobile phone.
In procedures such as spinal adjustments or injections, it is also common for patients to accuse the doctor of sexual harassment, claiming they were unable to resist or refuse the treatment due to the doctor's authority. To avoid such situations, it is crucial to obtain written consent from the patient prior to any treatment (or from the patient's guardian if the patient is a minor or elderly).
There are also cases where patients attempt to take advantage of the economic difficulties faced by medical institutions by recommending treatments without prescriptions or suggesting fraudulent patients. Patients may say, "Other hospitals are doing the same, and no one has been caught," attempting to lure financially struggling doctors into unethical practices.
While patients are customers of doctors, they sometimes view doctors as targets for exploitation and manipulation. In today's world, where mobile phones, social media, YouTube, and AI deepfakes (fake videos and audio) are becoming commonplace, doctors must be especially cautious when treating patients, ensuring they pay close attention to every detail. Some malicious patients even travel from one hospital to another, causing misdiagnoses and then using these mistakes to threaten doctors.
The Hardship of the Medical Profession
It seems that being a doctor is a particularly challenging profession.
